3. Mike Schook

Erickson testified that after the murder and after seeing and talking to Mallory he and Ryan went back to the By George Night Club around 2:45am.

Erickson testified he saw the same bouncer (Mike Schook) who had let them in earlier that night when they had gone to the club the first time. 

He testified they entered the bar the second time and that Mike Schook the bouncer/doorman let them in around 2:45 a.m.

Erickson testified:
* he and Ryan returned to the club without any money (Tr. P568)
* the music was loud and people were drinking and dancing.
* that there was a policeman waiting outside next to his squad car, so they could  not leave the club for 1-2 hours. 

This would have made the time around 4:00 -4:30 a.m.
He said that when they left the club the streets were crowded with cars and people.

Police records show that there was not an officer at that location at that time on that night.

The bouncer, Mike Schook, testified for the first time at the July Hearing. He said he was NEVER present at the club after 2:15 a.m.
 
Schook testified the club always closed at 1:30 a.m. and the doors were always locked at that time. 

In the club's 10-year history they had never received a summons for being open after hours.

None of Erickson's story is possible because the club closed at 1:30.
No witnesses have ever been found who support his story.  
According to Erickson's testimony, they left the club because they had no money.  
So why would they chose to return to the club later if they still had no money? 
Erickson later came up with the story that once inside the club, Ryan allegedly found a $20 bill in his wallet and bought drinks.

Erickson could not have seen the bouncer Mike Schook.
Could not have returned to the club as Erickson testified.
Could not have heard loud music or seen people dancing and drinking
Could not have seen a police officer standing by his car while waiting inside the club.
Could not have left with a crowd 2-3 hours later.

Could not have seen or talked to Dallas Mallory.
Could not have yelled out to Shawna Ornt “Get Help Someone Is Hurt”.

Shawna Ornt had told Prosecutor Crane three times prior to the 2005 trial that the suspect she saw was not Ryan or Chuck.

Prosecutor Crane failed to follow the law and inform Ryan’s Defense Team
This is a Brady Violation
