The following is a recap of some of the important facts which clearly show that Ryan had nothing to do with this crime:
1.)  Motive: Prosecutor said their motive for robbing the victim and killing him was because Chuck and Ryan had run out of money and Ryan's sister would not loan them any more money at the club. This allegation was never proven.

Yet during the trial the prosecutor said they robbed the victim so they could obtain money and return to the club. The robbery and murder occurred around 2:22am. The bar closed at 1:30am. Therefore the prosecutor's motive does not make sense.

NO MONEY was taken from the crime scene.

The only items taken were a Timex watch and a set of keys as per the police. Heitholt's wallet was still setting on the console in his car when police arrived on the scene.

Ryan and Chuck knew at least ten people their age at the bar. They could have borrowed money from any of these people.

2.)

The day he was arrested, Chuck did not remember Ryan making any cell phone calls between 1:41a.m. and 2:09 a.m., yet Ryan was on the phone continuously during this time. What was Chuck doing while Ryan was on the phone for 28 minutes?

The truth is that Chuck had already been taken home by Ryan. That is why Chuck knew nothing about the cell calls until he read about them in 'discovery'.

3.)

Chuck could not remember Michael Boyd's color/race even though he passed within ten feet of where Chuck said he was hiding while waiting to rob the victim. See police report 18 and 25. Boyd said he spoke with the victim for 3-5 minutes.

Chuck never mentioned this, doesn't remember this and never spoke of this conversation. Are we to believe Boyd was wrong about his conversation with his friend?

Chuck does not remember seeing the victim pouring out cat food from a Friskie's box just 4 feet from where Chuck said he was hiding.

4.)

Chuck did not remember how many times he hit the victim. He stated that he hit the victim only once. He repeated this at least three times before Detective Short corrected him.

The victim was actually hit 11 times. Detective Short told Chuck the victim was hit over 15 times.

This conversation occurred during the first video on the day of Chuck's arrest. Initial statements usually contain the most reliable information.

5.)

Chuck did not know what Ryan allegedly used to strangle the victim.

First, he said the victim was face up and Ryan used his hands.

Next, he said Ryan used a shirt taken from the victim's car.

When he was told this wasn't correct, he guessed that Ryan must have used a bungee cord.

Finally, out of frustration Detective Short told Chuck a belt was used; "the victim's own belt!" This revelation is much to the surprise of Chuck. His response: "The guys own belt?", "Really?", "No I don't remember that at all!"

This exchange was between Detective Short and Chuck the morning of his arrest.

6.) Chuck told Detective Short that after the crime, he and Ryan were chased out of the parking lot but he did not know by whom. Yet no one ever chased the perpetrators. (Police Report 254) the day of Erickson arrest March 10, 2006.
7.)

Chuck told Detective Short that within seconds of leaving the crime scene they encountered Dallas Mallory at the intersection of Ash and Providence. He said Mallory was with two girls. Chuck could not identify the car or the girls.

In fact, these two girls have never been identified by anyone! The location where Chuck said he saw Mallory is a major intersection in Columbia. Chuck said Mallory was stopped at the intersection facing south on Providence waiting for the light to change.

Yet MoDOT has provided a certified document stating the lights were flashing yellow after midnight. Chuck said while Mallory was stopped, he walked over to the driver's side and had a conversation with him, basically telling Mallory that they had just committed a crime.

REALLY? Why would anyone stop at a flashing light in the middle of a busy well traveled street? This sounds like another part of Chuck's dream.

8.) Chuck told Detective Short that after Mallory drove off he and Ryan went back to the By George Night Club. This would have been between 2:30 a.m. and 3:00 a.m., well after the bar was closed. Chuck said they stayed for over an hour.

He also said they bought drinks. Yet they had no money! Remember ... the victim's wallet had not been touched.

Police said no money had been taken from the victim
