At
this point,
according to Chuck's
testimony, he was
traveling the
opposite direction
back to"By
George"
(PR # 332,
PR# 42,
Chuck's June Deposition,
map # II)
The
K-9 unit eventually
reached McDavid
Hall, on the
university campus.
At this point the
dog handler and his
dog would have been
3 1/2 blocks
southeast of where
Chuck said he turned
west.
In
the deposition he
gave on June 30,
2005, Chuck said
this is when they
turned west and ran
to the creek where
he washed his hands.
He then said they
climbed the hill and
found themselves on
Providence Road
walking towards
Locust where they
run into Dallas
Mallory, who he said
was stopped at a red
light at the
intersection of
Locust and
Providence. It was
after this encounter
that he said they
headed back to the
night club.
Please
note that MoDOT has
provided evidence
that the light was
not red but flashing
yellow at that time
of the morning.
He
said he recognized
the doorman as they
walked past the bar
on their way back to
Ryan's car:

Chuck
stated that after
taking the murder
weapon, watch and
keys to the car and
placing them in a
plastic bag, they
returned to "By
George" and
were allowed to
re-enter the night
club.
He
said the same
doorman/bouncer that
had let them into
the club earlier
that night let them
in this second time.
(Time frame would
have been after 2:30
a.m.)
He
said that he and
Ryan re-entered the
bar and stayed for
about 1 1/2 to 2
hours. This would
have been
impossible, because
the bar had closed
at 1:30 a.m. Plus
the doorman, who we
have located, has
stated he was not
present after 2:15
a.m. and has written
a sworn affidavit
stating this
critical fact. !!!!
During
this time, Chuck
alleges that they
did not leave
because there was a
policeman in the bar
parking lot. If
a policeman had been
in the "By George"
parking lot after
the legal closing
time, he would have
cited the club for a
violation and it
would have been
documented in a
police report.
Also,
records of police
activity that
evening show no
citation against the
club and no
indication that a
police officer was
in the vicinity of
the club parking
lot.
However,
there was a police
officer issuing a
parking ticket just
one block away at
2:05 am in the
Salvation Army
parking lot. This
was close enough to
observe activities
of the "By George
Nightclub". If
indeed the bar had
been open after 2
a.m., this police
officer should have
investigated. (Record of police activity Oct. 31, 2001-Nov.1, 2001)
Chuck
Erickson said that
when he and Ryan
finally left "By
George", they
drove down
Providence Road and
passed the Tribune
parking lot, where
they saw the victim
in a body bag. But
Jeff Nichols
testified in court
that the body wasn't
bagged until
approximately 5:19
a.m., well after
Chuck said he and
Ryan left the bar.
In
addition, when
driving south on
Providence Road past
the alley leading
into the Tribune
parking lot, it is
impossible to view
the area in which
Kent Heitholt's
car was parked and
where the body was
being loaded. The
brick enclosure
which was mentioned
earlier, stood
nearly five feet
high, was located at
the corner of the
parking lot and
extended several
feet in both
directions,
obstructing any view
of the area from
Providence Road.
This
is yet another
unbelievable,
unrealistic twist
which is not
possible in Chuck
Erickson's story.
This information
came from Detective
Nichols during the
trial. Detective
Nichols didn't
think anyone driving
south on Providence
could actually look
up the alley and see
the crime scene,
much less the
victim.
He
also said in his
June 30, 2005 deposition,
that
Ryan then drove him
to his house and
dropped him off
before continuing on
to his own house.
This would have been
hours after Ryan
says he drove Chuck
home and then went
to his own home.
