Recap continued: |
|
9.) |
In Chuck's June deposition, he knew he had
to have an explanation for this so he conveniently changed his story to say that
once he and Ryan got back to the night club Ryan magically remembered that he
had a twenty dollar bill hidden in his wallet.
He said that's how they were able to buy drinks
at the By George Night Club after 2:30 a.m. even though they had run out of
money and did not take any money from the victim. Erickson had never mentioned
this before. This seems a little too contrived.
Why would they have returned to the club if they
had no money?
|
|
|
10.) |
Erickson told Police he did not remember
taking anything from the crime scene. |
|
|
11.) |
There are many other inconsistencies which
you can read in Police Report 254 and 301 as well as the transcripts of the
Police videos filmed March 10, 2004 the day of Chuck's arrest. |
|
|
12.) |
Chuck's October 1, 2004 Proffer (Police
Report 332) presents a completely different story than the one which was
documented on the day of his arrest. His story changed continually. |
|
|
13.) |
In his proffer, Chuck magically
"remembered"
the number of times he hit the victim. He also suddenly "remembered" all the
details of how Ryan strangled the victim with the belt, which had been a
complete surprise to him on the day of his arrest.
He also now "remembered" specifically what
had been taken and who carried the items.

|
|
14.) |
At
the time of Chuck's proffer (October 1, 2004), seven months after his arrest,
he changed many of the facts in his story.
He changed his story to says that they left the
crime scene traveling east up the alley to 4th street and south to the diner,
then on to Flat Branch. He says they went over the creek and up a steep bank to
the intersection of Locust and Providence where he conveniently changed the
location of where he says he saw Dallas Mallory.
Remember, in Police Report 42 the police tracking
dogs continued due south to Locust, not west to Providence as Chuck reported.
|
|
|
15.) |
He
stated that Mallory was sitting at a stoplight. Chuck said he walked over to the
car while Mallory was waiting for the light to change. He reported that there
were two girls in the car with him. He said that after a brief conversation,
then Mallory continued south on Providence.
Chuck again changed his story to say that he and
Ryan traveled in a northwest direction back towards the "By George Night
Club".
He also changed his story to say they went to
Ryan's car to drop off the tire tool, watch and car keys before they were
allowed back in the night club by the same doorman that had let them in earlier
that evening.
The time would now be between 2:30 a.m. and 3:00
a.m. We have a sworn affidavit from the doorman stating the club closed at 1:30
a.m. and that he and others finished their cleaning duties and departed the club
by 2:15 a.m. at the latest.
The doorman stated in this sworn affidavit that
he NEVER stayed at the club beyond 2:15 a.m. during his two years of employment
at "By George".

16.) |
As you can see, Erickson's story is wrong
on so many levels. His story is dreamlike at best. His version of events could
not have happened.
For his story to be correct, Dallas Mallory,
Michael Boyd and all the people at the "By George Night Club" would
have to be mistaken and only Erickson's story be the one that is believable.
IT IS JUST NOT POSSIBLE! There is not one other
person who can verify or confirm anything about Chuck's incredible story!
|
|
|
17.) |
Please keep in mind the prosecutor has admitted there was
NO evidence, DNA,
fingerprints or anything else that connected either Chuck or Ryan to the crime
scene.
Additionally, no evidence was found in Ryan's
car or Chuck's house ...
NO EVIDENCE ...
only Erickson's self-serving statements and
emotions have found Ryan guilty ... he justice system has truly failed.
